Probate is the process of settling the estate of a deceased person. This typically involves the distribution of assets and resolution of claims that may be filed against the estate. Q: Who will take care of my medical and financial affairs if I ever become physically or mentally incapacitated?

A: You may want to consider naming someone to take care of your affairs in the event that you are ever unable to care for yourself and make important financial and medical decisions.  This person may be a spouse, a child, a parent, or a close friend, so long as it is someone that you trust.  If you decide that you would like to name someone to act in this capacity you can name them as your attorney-in-fact through a document called a Power of Attorney.  A Power of Attorney will allow the named individual to either make health care decisions on your behalf or make financial decisions on your behalf or both.  You should consult with an attorney to determine what type of Power of Attorney is best for your situation and needs.
